TOTAL LIABILITY OF FYWN AND/OR ITS DEALERS, ASSOCIATES, AGENTS AND
LICENSORS UNDER ANY PROVISION OF THESE TOU, WHETHER IN AN ACTION OF
CONTRACT, NEGLIGENCE OR OTHER TORTIOUS ACTION, SHALL BE LIMITED TO THE
TOTAL DOLLAR AMOUNT ACTUALLY PAID FOR THE INFORMATION OR PRODUCTS GIVING
RISE TO THE LIABILITY.
FYWN
Registration:
To register for the
FYWN, you will have to create a member account and pay the membership
fee. As a condition to
using such components of this website, you will be asked to register and
select a password and screen name ("User ID"). You shall provide
accurate, complete, and updated registration information. Failure to do
so shall constitute a breach of this TOU, which may result in immediate
termination of your account. You may not (i) select or use as a User ID
a name of another person with the intent to impersonate that person;
(ii) use as a User ID a name subject to any rights of a person other
than you without appropriate authorization; or (iii) use as a User ID a
name that is otherwise offensive, vulgar or obscene. FYWN reserves the
right to refuse registration of, or cancel a User ID in its sole
discretion. You are solely responsible for the activity that occurs on
your account, and you must keep your account password secure. You must
notify FYWN immediately of any breach of security or unauthorized use of
your account. Although FYWN will not be liable for your losses caused by
any unauthorized use of your account, you may be liable for the losses
of FYWN or others due to such unauthorized use. All registration
information provided by you shall be subject to FYWN’s
Privacy Policy or any successor thereto.
Membership Fees &
Cancellation:
You may cancel your
FYWN membership at any time; however, all membership fees paid for
annual and monthly subscriptions are nonrefundable.
If you are being billed monthly for your FYWN membership, your
membership cancellation must be received at least five days prior to
your billing cycle in order to prevent being billed for the next month.
FYWN will not be responsible for any cancellation notices that are not
received via email or mail.
User Conduct:
As
a condition of use, you agree not to use this Website for any purpose
that is unlawful. You agree to abide by all applicable local, state,
national and international laws and regulations, including, without
